Iowa Group Life Insurance and Incontestability
Incontestability (Iowa Code 508.28)
Iowa requires every individual life insurance policy to be incontestable after 2 years in force during the insured’s lifetime. Once the policy clears the two-year mark, the insurer cannot rescind based on application misrepresentation — even a material one — except for nonpayment of premium and certain narrow exceptions (e.g., fraud in jurisdictions where it survives incontestability). Inside the first two years, an insurer that uncovers a material misrepresentation may rescind and return premiums.
Iowa Group Life Insurance (Iowa Code Chapter 509)
Eligibility (Iowa Code 509.1)
Iowa Code 509.1 defines the categories of eligible groups for group life insurance. Eligible groups include:
- Employer groups — groups of employees of a single employer.
- Labor union groups — groups of members of a labor union.
- Trustee groups — groups insured under a trust arrangement (multiple-employer or association).
- Credit union groups, professional association groups, and other defined categories.
The defining feature of a group is that underwriting is done on the group as a whole, not on individual members; eligible members typically obtain coverage with little or no individual underwriting.
Required Provisions (Iowa Code 509.2 and 509.10)
Iowa Code 509.2 and 509.10 specify required provisions for Iowa group life policies, including:
- Grace period for premium payment.
- Incontestability clause.
- Misstatement of age provision.
- Beneficiary designation rules.
- Certificate of insurance to each insured member.
- Evidence of insurability standards where required.
Conversion to Individual Policy (Iowa Code 509.2)
When group life coverage ends — whether because the employee leaves the group, the group policy is terminated, or other defined events — the covered individual generally has the right to convert to an individual life policy without evidence of insurability, provided the conversion application and first premium are made within the defined conversion window. Iowa Code 509.2 sets the procedural framework. Conversion preserves access to life coverage for individuals who may otherwise be uninsurable at attained age and current health.
Assignability (Iowa Code 509.15)
Iowa Code 509.15 permits an Iowa group life certificate to be assigned by the insured, subject to the terms of the master group policy. Assignment can be useful in estate planning, charitable giving, or as collateral for a loan. The assignment must be in writing and delivered to the insurer.
Interest on Proceeds (Iowa Code 511.38)
Iowa Code 511.38 requires insurers to pay interest on life insurance proceeds that are not paid within a defined period after the insurer receives proof of death. The statutory interest rate ensures that beneficiaries are made whole for delays in claim payment. The rate is set by statute and adjusts based on market conditions; insurers cannot avoid the interest obligation by simply delaying payment.
